Terms of Service

1. Acceptance of Terms

By accessing or using FIVE STACK ("fivestacks.dev", the "Service"), operated by FIVE STACK ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FIVE STACK is an AI-powered code generation platform that converts design inputs (Figma files, text prompts) into production-ready frontend and full-stack code. The Service utilizes third-party AI models via API providers (including but not limited to OpenRouter, OpenAI, Anthropic, Google, and others) to generate code output.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credit System & Usage

The Service operates on a credit-based system. Each AI generation consumes credits based on the model used. Credits are non-transferable and non-exchangeable. Unused credits from monthly subscriptions do not roll over to the next billing period. Upon subscription renewal, credits are reset to the plan's allocated amount.

Credit consumption occurs at the time of AI model invocation. Once a request is sent to a third-party AI provider, the associated credits are consumed regardless of the output quality, as we incur API costs for each request. This is a fundamental aspect of the Service and is non-negotiable.

5. Subscriptions & Payments

Paid subscriptions are billed on a recurring monthly basis through our payment provider, Paddle. By subscribing to a paid plan, you authorize recurring charges. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are handled by Paddle in accordance with their refund policy. Prices are subject to change with 30 days' notice. All prices are inclusive of applicable taxes as calculated by Paddle, our Merchant of Record.

6. Credit Top-Ups

One-time credit purchases ("top-ups") are added to your account balance immediately and are consumed under the same rules as subscription credits. Top-up credits do not expire as long as your account remains active. Refunds for credit top-ups are handled by Paddle in accordance with their refund policy.

7. Intellectual Property

You retain full ownership of all code generated through the Service using your inputs. We do not claim any intellectual property rights over your generated output. However, the Service itself, including its interface, branding, underlying technology, and documentation, remains our intellectual property.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Abuse, exploit, or circumvent the credit system or subscription limits
• Share account credentials or resell access to the Service
• Use automated tools to scrape, crawl, or overwhelm the Service
• Generate content that violates applicable laws or third-party rights

9. Third-Party AI Services

The Service relies on third-party AI model providers. We do not guarantee the availability, accuracy, or quality of AI-generated outputs. AI model availability may change without notice based on third-party provider decisions. We are not liable for any damages arising from AI-generated output, including but not limited to code errors, security vulnerabilities, or incompatibilities.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, FIVE STACK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability shall not exceed the amount paid by you to us in the 3 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or abuse of the Service. Upon termination, your access to the Service and any remaining credits will be revoked. You may request account deletion at any time by contacting us.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email or in-app notification.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany. Any disputes shall be resolved in the courts of Germany.
